Holding

The Court provisionally granted anticipatory bail to the petitioner, subject to conditions and verification of his criminal antecedents.

Summary

The petitioner, Om Prakash Kumar, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 790.56 litres of liquor from an orchard not owned by him, claiming he was implicated solely on the basis of a chowkidar's information without any material seized from his possession. He applied for anticipatory bail, arguing that the investigation was mechanically initiated and that he had only one prior excise case. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.5,000 with two sureties, subject to verification of the petitioner’s criminal antecedents under Section 482(2) of the BNSS. The order stipulated that if more than one prior case is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The petitioner was also directed to deposit Rs.2,500 with the High Court Legal Services Committee within two weeks.

Issues considered

  • What is the appropriateness of granting anticipatory bail under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act?
  • Whether the petitioner’s prior criminal antecedent (more than one case) affects the grant of anticipatory bail.

Subjects

  • anticipatory bail

  • Section 30(a)
  • Section 482(2)
  • criminal antecedent
