Holding

The court disposed of the petition, holding that the case had become infructuous and therefore the cognizance order was not quashed.

Summary

The petitioner, Ranjeet Jha, filed a petition under Section 482 of the Criminal Procedure Code seeking to quash a cognizance order dated 22 September 2017 issued by the Sub‑Divisional Judicial Magistrate, Supaul, in Complaint Case No. 292 of 2017. The cognizance order had taken the petitioner into account under Sections 323, 504 and 498(A) of the Indian Penal Code. The petitioner argued that the proceedings had become infructuous and therefore should be disposed of. The State of Bihar, represented by an Additional Public Prosecutor, raised no objection to the petitioner's prayer. After considering the submissions, the Patna High Court held that the petition was to be disposed of on the ground that the case had become infructuous.

Issues considered

  • Whether the cognizance order dated 22‑09‑2017 should be quashed under Section 482 Cr.P.C.
