Holding

The Court granted provisional anticipatory bail to the petitioner with specified conditions, subject to verification of his criminal antecedents.

Summary

The petitioner, Rajkishor Yadav, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 30 litres of liquor were recovered from a location not belonging to him and that he was implicated by a hostile chowkidar. He contended that the police had mechanically implicated him without proper investigation and that no liquor was found in his conscious possession. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and conditions under Section 482(2) of the CrPC, including verification of the petitioner’s criminal antecedents. The order stipulated that if more than one antecedent case is found, the bail would not be confirmed; if only one antecedent is found, the bail would be confirmed. The petitioner also undertook to deposit Rs.2,500 with the Advocates’ Association, Patna High Court.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the circumstances of alleged recovery and the petitioner’s relationship with the informant justify denial of bail.
  • Whether the conditions imposed under Section 482(2) of the CrPC are appropriate for provisional anticipatory bail.
