Patna High Court

Nitish Kumar @ Nitish PrasadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner under Section 438(2) of the Criminal Procedure Code.

Summary

The petitioner, Nitish Kumar, was implicated in a case (Minapur P.S. Case No. 335 of 2023) involving alleged mob assault, robbery and other offences under various IPC sections. He contended that he was merely a member of the mob and that no specific allegation of assault was made against him, emphasizing his clean criminal record and a land dispute background. The State opposed his anticipatory bail application. The Court examined the FIR and the earlier order, finding no direct accusation against the petitioner and noting his lack of antecedents. Consequently, the Court granted anticipatory bail under Section 438(2) of the CrPC, subject to a bond of Rs.10,000 and two sureties, valid for six weeks from the order date.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in the absence of a specific allegation against him
  • Whether the petitioner’s clean antecedent and the nature of the allegations justify bail under Section 438 of the CrPC
