Patna High Court

Sanatan Kumar @ Sonu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Sanatan Kumar, was arrested in connection with an excise case alleging possession of 130 litres of liquor recovered from a motorcycle, invoking Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed false implication, noting no liquor was found in his personal possession and he had no link to the vehicle, though he had been in custody since 11‑11‑2025 and possessed four prior criminal records. The State opposed bail, while the petitioner highlighted non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The court, after considering the facts, the duration of custody, and the lack of direct evidence, decided to grant bail. Bail was ordered on a bond of Rs.15,000 with two sureties, subject to conditions regarding family surety, appearance at trial, and non‑tampering with evidence or witnesses.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the facts of the case.
  • Whether the non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, precludes the grant of bail.
  • Whether the petitioner’s prior criminal antecedents and period of custody affect the bail decision.
