Patna High Court

Shiv Kumar Sao @ Shiv SaoversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, subject to bond and surety conditions.

Summary

The petitioner, Shiv Kumar Sao, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 200 litres of liquor recovered from four motorcycles. He contended that he was falsely implicated, had no incriminating article in his possession, was not linked to the vehicles, had no prior criminal record, and that the statutory requirement of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, was not complied with. The State opposed bail. Considering the lack of direct evidence, the petitioner’s clean antecedent, and the period of custody already served, the Court decided to grant bail on the condition of a Rs. 15,000 bond with two sureties and compliance with specific conditions regarding family surety and regular court appearances.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the facts of the case
  • Whether the non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, affects the grant of bail
