Holding

The Court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Akhilesh Ram, sought anticipatory bail after a case was registered under Sections 30(a) and 32(3) of the Bihar Excise Act for the alleged recovery of 7,662.6 litres of liquor from a truck and five pickup vehicles. He argued that he was not arrested on the spot, no liquor was found in his possession, and he was implicated merely because he owned one of the seized pickups, claiming he was unaware of any misuse by the driver. The State opposed the bail application. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and directed verification of the petitioner’s criminal antecedent. The order stipulated that if the petitioner is found to have more than one prior case, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the BNSS in a case under the Bihar Excise Act.
  • Whether the petitioner’s ownership of a vehicle used in the alleged offence, without possession of the contraband, suffices to deny bail.
  • Effect of the petitioner’s prior criminal antecedent on the grant of anticipatory bail.

petitioner was not arrested from the spot as such nothing was

recovered from his conscious possession and he came to be

implicated based on the fact that he is owner of one of the seized

would use his own vehicle for committing an occurrence and

thus would create evidence against himself and hence would get

implicated, it is further submitted that petitioner was completely

unaware that the driver of the vehicle would misuse the vehicle

          in the manner as alleged.

          anticipatory bail of the petitioner.

                   6. Considering the submissions made by the learned

                   7. It is made clear that thereafter the learned Trial

Court shall verify the criminal antecedent of the petitioner and

in the event if it is found that petitioner has antecedent of more
