Patna High Court

Manish Kumar @ Manish Kumar SahniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail, subject to a bond and sureties, as the allegations do not constitute a serious offence and he has no criminal antecedent.

Summary

The petitioner, Manish Kumar, was arrested in connection with a case (PS No. 123 of 2025) alleging offences under several sections of the B.N.S., including assault on an informant and her family. The petitioner claimed he was falsely implicated, asserting no prior criminal record and that the informant lodged the case out of personal animosity because he married her niece. The State opposed bail, while the petitioner’s counsel argued the injury was simple and the allegations were unsubstantiated. The court examined the facts, noting the petitioner’s clean record and the nature of the alleged injury, and concluded that bail was appropriate. Accordingly, the court ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S.S.
