BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners, holding that the circumstances justified bail under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioners – Mahesh Mahto, Deepak Mahto and Pankaj Kumar – applied for anticipatory bail in connection with Police Station Keshariya Case No. 464 of 2025, wherein they were alleged to have assaulted an informant and others using an iron rod, sword and lathi during a dispute over rain‑water drainage. The FIR lists offences under Sections 126(2), 115(2), 118(1), 109, 76, 303(2), 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023. The petitioners argued that they are agnates of the co‑accused Dinesh Mahto, the injuries caused were simple, and a co‑ordinate Bench had already granted anticipatory bail to Dinesh Mahto in a related matter. The Court considered these submissions, the nature of the alleged offences and the precedent of the earlier bail order. Finding the injuries minor and noting the similarity to the co‑accused’s case, the Court exercised its power under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and granted anticipatory bail to all three petitioners, subject to bail bonds and sureties. The order directed that the bail be effected if the petitioners are arrested or surrender within four weeks.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 despite the serious nature of the offences alleged under the Bhartiya Nyaya Sanhita, 2023.
  • Whether the fact that the petitioners are agnates of a co‑accused who has already been granted anticipatory bail influences the decision.
