Patna High Court

Ganesh RaiversusThe State Of Bihar

Decided

Holding

The petition under Section 482 CrPC is dismissed as infructuous because the petitioner has already been acquitted.

Summary

The petitioner, Ganesh Rai, filed a petition under Section 482 of the Criminal Procedure Code seeking to quash an order dated 02-08-2018 of the Sessions Judge which had rejected his earlier petition under Section 227 CrPC. The petition argued that the matter had become infructuous because the petitioner had already been acquitted on 31-07-2024 in the same case (S. Tr. No. 348 of 2017). The State of Bihar raised no objection to the petitioner's request for disposal. The High Court examined the report from the trial court confirming the acquittal and noted that the pending petition was rendered moot. Consequently, the Court disposed of the petition as infructuous, without further order.
