Patna High Court

Neeraj Pathak @ Abhay PathakversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to bond and surety conditions.

Summary

The petitioner, Neeraj Pathak, was arrested in connection with a case alleging possession of 150 litres of liquor recovered from a motorcycle, invoking Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was falsely implicated, no liquor was found in his personal possession, and he had no link to the vehicle, though he had been in custody since 25‑10‑2025 and possessed two prior criminal records. The prosecution opposed bail, while the petitioner’s counsel highlighted the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The court, considering the circumstances and duration of custody, decided to grant bail, imposing a bond of Rs.15,000 with two sureties and specific conditions regarding family surety and trial attendance. The bail order was issued by Justice Rudra Prakash Mishra.
