Holding
The court held that regular bail could not be granted to the petitioner.
Summary
The petitioner, Bhola Bhokta, was charged in Lutua Police Station Case No.02 of 2018, pending before the Additional Sessions Judge-IV, Sherghati, Gaya. He filed a second application for regular bail (Criminal Miscellaneous No.59205 of 2025) after an earlier bail plea was rejected on 11-12-2024. The petitioner’s counsel, Ms. Leelawati Kumari, argued for release, while the State, represented by APP Mr. Dr. Mrityunjaya Kr. Gautam, opposed the bail. Justice Satyavrat Verma examined the nature of the allegations and the stage of the proceedings and found no sufficient ground to grant bail. Consequently, the court rejected the bail application, maintaining the petitioner’s custody.
