Holding

The application under Section 482 was disposed of as infructuous, and no order was quashed.

Summary

Kalanand Yadav was charged under IPC sections 341, 308, 504 and 506 in a case arising from Pipra P.S. Case No. 72 of 2016. The trial court took cognizance and the matter proceeded through various orders, including a revision. The petitioner was acquitted by the Sessions Court on 1 August 2025. He filed a criminal miscellaneous application under Section 482 of the CrPC seeking to quash the earlier orders, arguing that the case had become infructuous. The State did not oppose the petition. The High Court, after considering the acquittal report, disposed of the application as infructuous, finding no need to entertain the quash petition.

Issues considered

  • Whether a criminal miscellaneous application under Section 482 of the CrPC is maintainable when the accused has already been acquitted.
  • Whether the earlier orders taking cognizance and the revision order should be quashed in view of the acquittal.
