The court granted provisional anticipatory bail to the petitioner, subject to conditions and verification of his antecedent.

Summary

Dharmendra Paswan sought anticipatory bail after a FIR was lodged under Section 30(a) of the Bihar Excise Act alleging recovery of 117.68 litres of liquor from his residence. He argued that he has a clean antecedent, was not arrested at the scene, and that the liquor was located in a joint family house, making it uncertain that he had conscious possession. The petitioner also questioned why the chowkidar, who allegedly knew of his involvement, did not inform police earlier. The State opposed the bail, but the court noted that the 2018 amendment to the Excise Act abolished the doctrine of deemed possession and presumed offender. Accordingly, the court granted provisional anticipatory bail subject to a bond of Rs. 500 with two sureties and a condition that the trial court verify his antecedent before confirming the bail.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the concept of deemed possession and presumed offender applies post‑2018 amendment to the Bihar Excise Act.
  • Whether the joint family nature of the property negates inference of possession by the petitioner.

  • anticipatory bail
  • excise law
  • possession

  • Section 30
  • Bihar Excise Act
  • Section 482
