Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to the stipulated conditions.

Summary

The petitioners, four residents of Balha village, sought anticipatory bail fearing arrest in a criminal case (Keoti PS Case No. 220 of 2025) that alleged offences under multiple sections of the B.N.S. The prosecution alleged that the petitioners brutally assaulted the informant's sons and attempted to outrage the modesty of his daughters on 1 September 2025. The petitioners contended they were falsely implicated due to a land dispute and village politics, asserting that the matter had been compromised and a compromise petition was on record. The State opposed the bail application. The Court, after considering the compromise and the petitioners' clean antecedents, exercised its power under Section 482 of the B.N.S.S. to grant anticipatory bail, subject to a bond of Rs.10,000 with two sureties and the condition that one bailor be a close relative.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482 of the B.N.S.S.
  • Whether the compromise petition and clean antecedents justify bail despite serious charges
  • Whether the alleged offences under Sections 126(2), 115(2), 118, 74, 76, 77, 109, 303(2), 351(2), 352 and 3(5) of the B.N.S. preclude bail

                                       ORAL ORDER

2 04-02-2026 Heard learned counsel for the petitioners and learned

                   APP for the State.

                                2. The petitioners are apprehending their arrest in

connection with Keoti P.S. Case No. 220 of 2025 for the offence

                   under Sections 126(2), 115(2), 118, 74, 76, 77, 109, 303(2),

                   351(2), 352 and 3(5) of the BNS.

                                3. As per the prosecution story, the informant has

alleged that on 01.09.2025, all the F.I.R. named accused persons

brutally assaulted his sons, as a result of which they sustained

injuries. It is also alleged that they tried to outrage the modesty

of the daughters of the informant.

                       4. Learned counsel for the petitioners submits that the

petitioners are quite innocent and they have committed no

offence at all rather they have been falsely implicated in the case

due to previous land dispute and local village politics. Both the

parties are agnates and neighbours and due to land dispute, a

simple scuffle took place between the parties wherein both the

parties sustained injuries. Learned counsel further submits that

the case has been compromised by both the parties and copy of

compromise petition has been brought on record as Annexure-

P/3. A statement has been made in para 3 of the bail application

          that petitioners have clean antecedents.

                       5. Learned APP opposes the prayer for bail.

                       6. Keeping in view the aforesaid facts, this Court is

inclined to extend them the privilege of anticipatory bail.

                       7. Let the petitioners be released on bail in the event

of arrest or surrender within a period of four weeks from the

date of receipt of this order, on furnishing bail bond of Rs.

10,000/- (Ten thousand) each with two sureties of like amount
