Patna High Court

Sanju DeviversusThe State of Bihar

Holding

The Court granted provisional anticipatory bail with conditions, pending verification of the petitioner’s antecedent.

Summary

The petitioner, Sanju Devi, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act involving alleged recovery of liquor. She argued that the liquor was not in her conscious possession, the location was public, and the complaint was based on the testimony of a chowkidar and locals without proper investigation. The State opposed the bail. The High Court, applying Section 482(2) of the Criminal Procedure Code, granted provisional anticipatory bail subject to a Rs.10,000 bail bond, two sureties, and a condition that the trial court verify her criminal antecedent. If more than two prior cases are found, the bail would not be confirmed; if exactly two, it would be confirmed. The petitioner also agreed to deposit Rs.5,000 with the Advocates’ Association within two weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the CrPC in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.

recovery is from a place which does not belong to the petitioner

and is accessible to public at large and she came to be
