Patna High Court

Md. Alamgir @ Md. AlamversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The court held that provisional anticipatory bail may be granted, subject to verification of the petitioner’s antecedents, in the circumstances presented.

Summary

The petitioner, Md. Alamgir, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 after 9.36 litres of liquor were recovered from a motorcycle he owned. He argued that he had no knowledge of the driver’s misuse of the vehicle and possessed a clean criminal record. The State opposed his request for anticipatory bail. The High Court, considering the facts, granted provisional anticipatory bail subject to a modest bail bond and two sureties, and directed the trial court to verify the petitioner’s antecedents before confirming the bail. If any prior case is found, the bail would be presumed concealed and not confirmed; otherwise, it would be confirmed. The order was made under Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
  • Whether ownership of the vehicle used in the alleged offence justifies granting anticipatory bail.

                                3. Learned counsel for the petitioner submits that

came to be implicated based on the fact that he is owner of the

seized vehicle. It is next submitted that no prudent person would

use his own vehicle for committing an occurrence and thus

                       6. It is made clear that the learned trial court thereafter
