Decided
Disposal
BAIL REJECTED

Holding

The Court refused to grant pre‑arrest bail, dismissing the bail application.

Summary

Indu Devi, the wife of Saheb Yadav, applied for pre‑arrest bail in a case registered under Sections 363 and 366(A)/34 of the Indian Penal Code and Sections 8 and 17 of the POCSO Act. The trial was at the stage of final arguments before the Special Judge (POCSO Act) in Siwan. The petitioner argued for bail, but the High Court examined the seriousness of the offences, including alleged theft, kidnapping and child sexual offences. The Court held that the nature of the charges warranted the continuation of custody and was not inclined to enlarge bail. Consequently, the bail application was dismissed and the petition disposed.
