Patna High Court

Chandan Yadav @ Chandan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to specified conditions.

Summary

The petitioner, Chandan Yadav, sought anticipatory bail fearing arrest in a case (Rampur P.S. Case No.506/2025) alleging offences under several sections of the B.N.S. and Section 27 of the Arms Act. The prosecution alleged that the petitioner, along with others, assaulted an informant and later fired shots at him. The petitioner contended he was falsely implicated due to local political rivalry and that no specific injury report or assault allegation was made against him. The State opposed the bail application. The Court, after considering the allegations and the petitioner's claim of innocence, exercised its power under Section 482 of the B.N.S.S. to grant anticipatory bail, subject to a bond of Rs 10,000 with two sureties and the condition that one bailor be a close relative, to be effective for four weeks from the order date.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the applicable provisions given the allegations of assault and firing under the B.N.S. and Arms Act.

2 04-02-2026 Heard learned counsel for the petitioner and

                   learned APP for the State.

                                2. The petitioner is apprehending his arrest in

connection with Rampur P.S. Case No. 506 of 2025 for the

                   offence under Sections 126(2), 115(2), 352, 329(4), 109(1),

351(2), 351(3) and 3(5) of the BNS and Section 27 of Arms

                   Act.

                                3. As per the prosecution story, the informant has

alleged that on 01/10/2025 at around 10 PM, while he was

going to the market with his daughter, he was assaulted by

Mrityunjay Yadav, Nandan Yadav, Chandan Yadav

(petitioner), and others. On 02/10/2025 at around 1:00 PM,

15 unknown accused persons, returned, verbally abusing

him and banging at his door. When the informant went to

the terrace, co-accused-Nandan Yadav fired 5–6 rounds

from his pistol upon the informant, but he somehow

          escaped himself.

                       4. Learned counsel for the petitioner submits that

the petitioner is innocent and has committed no offence

rather he has falsely been implicated in the present case due

to local politics and personal enmity. There is neither any

injury report nor any allegation of assault has been made

against the petitioner whereas all the allegations are general

and omnibus in nature and against all the F.I.R. named

          accused persons including the petitioner.

                       5. Learned APP opposes the prayer for bail.

                       6. Keeping in view the aforesaid facts, this Court

is inclined to extend him the privilege of anticipatory bail.

                       7. Let the petitioner be released on bail in the

event of arrest or surrender within a period of four weeks

from the date of receipt of this order, on furnishing bail

bond of Rs. 10,000/- (Ten thousand) each with two sureties
