Patna High Court

Md. Taslim @ HaikalversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Bail was not granted to the petitioner.

Summary

The petitioner, Md. Taslim @ Haikal, was charged under Sections 120B, 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act in connection with a murder and conspiracy case (PS Tajpur Case No.113 of 2023). He had earlier applied for regular bail (Criminal Miscellaneous No.25768 of 2025) which was rejected on 18‑04‑2025. On 09‑01‑2026 he filed a fresh bail application (Criminal Miscellaneous No.60183 of 2025). The learned judge examined the earlier order and the seriousness of the offences, and found no sufficient ground to grant bail. Consequently, the bail petition was dismissed, and the petitioner remains in custody pending trial.

Issues considered

  • Whether bail can be granted in a case involving offences under Sections 120B, 302, 34 IPC and Section 27 Arms Act
  • Whether the petitioner’s prior bail rejection and the nature of the alleged crimes justify continued denial of bail
