Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners, subject to bond and surety conditions, exercising its inherent powers under Section 482 of the B.N.S.S.

Summary

The petitioners, a group of villagers from Mithauli, sought anticipatory bail fearing arrest in a criminal case (Rahika P.S. Case No. 161 of 2025) alleging offences under multiple sections of the B.N.S.S. The prosecution alleged that the petitioners participated in a mob assault on the informant's son on 25 June 2025, causing injuries. The petitioners contended they were falsely implicated due to village politics and that the FIR was lodged ten days after the incident without justification. The State opposed bail, arguing the seriousness of the offences. The Court, noting the lack of specific allegations against each petitioner and the possibility of political motivation, exercised its inherent powers under Section 482 of the B.N.S.S. and granted anticipatory bail subject to bond and surety conditions. The order directs release upon arrest or surrender within four weeks, with one bailor required to be a close relative.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482 of the B.N.S.S. despite the serious nature of the alleged offences.
  • Whether the FIR contains specific allegations sufficient to deny bail to the petitioners.
  • Whether the delay in filing the FIR and alleged political motives affect the grant of bail.
