The court granted anticipatory bail subject to bail bond conditions, noting the absence of an injury report and applying Section 438 CrPC and Section 482 BNSS.
Summary
Sudhir Kumar and Jai Kumar filed anticipatory bail applications fearing arrest in Patepur Police Station Case No. 143 of 2025, which alleged offences under several provisions of the Bharatiya Nyaya Sanhita, including assault and other offences. The prosecution claimed the petitioners assaulted the informant's husband, but the injury report was not produced in the record. The court first disposed the application, directing the petitioners to file a fresh anticipatory bail application after the injury report is produced. In the subsequent application, the court examined the lack of injury evidence and the petitioners' claim of innocence despite two prior criminal antecedents. The court allowed the anticipatory bail, imposing a bail bond of Rs.10,000 with two sureties and conditions under Section 438(2) of the CrPC and Section 482 of the BNSS, and ordered that the petitioners not be arrested until further orders.
Issues considered
- Whether anticipatory bail can be granted in the absence of an injury report.
- Whether the provisions of Section 438 CrPC and Section 482 BNSS are applicable to the petitioners' case.
- Whether the petitioners' prior criminal antecedents preclude the grant of anticipatory bail.
