Patna High Court

Monu Singh @ Monu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner on the condition of a Rs. 10,000 bond and two sureties.

Summary

Monu Singh, accused under multiple provisions of the Bharatiya Nyaya Sanhita and the Arms Act for assaulting an informant and his daughter and demanding extortion, applied for bail after being in custody since September 2025. The petitioner argued that the informant was linked to a rival criminal and that a co‑accused, Saurav Kumar, had been granted anticipatory bail in a similar case. The court considered these submissions, the precedent of anticipatory bail to the co‑accused, and the length of the petitioner’s detention. It held that bail was appropriate under the circumstances. Accordingly, the court ordered the petitioner’s release on a bail bond of Rs. 10,000 with two sureties, subject to the satisfaction of the Additional Chief Judicial Magistrate, Barh.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious charges under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the grant of anticipatory bail to a similarly situated co‑accused influences the decision on bail for the petitioner
