The bail applications were dismissed.

Summary

The petitioners Md. Azam, Raja Kumar Bhagat and Pawan Kumar Yadav applied for bail in a kidnapping and ransom case (PS Case No. 549 of 2025) under Sections 140(2), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita. The victim identified the accused, and the co‑accused’s statements implicated Md. Azam. The court noted that the accused have multiple criminal antecedents – two for Azam, one for Bhagat and ten for Yadav – and considered the seriousness of the offence. After evaluating the gravity of the kidnapping, the demand for a Rs. 4 lakh ransom, and the criminal records, the judge was not inclined to grant bail. Consequently, the bail applications were dismissed, with the court clarifying that the order is limited to the bail question and does not prejudice the trial. The judgment contains no discussion on the merits of the underlying criminal case.

Issues considered
