Patna High Court

Raj Kumar BindversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner.

Summary

Raj Kumar Bind was arrested after 43 litres of liquor was recovered from a public place and was charged under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for bail, asserting that he was falsely implicated, that no liquor was found in his possession, that he has no prior criminal record, and that the prosecution had not complied with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail application. The Court examined the lack of direct incriminating evidence, the petitioner’s clean record and the period of custody, and decided to grant bail. Bail was ordered on a bond of Rs.15,000 with two sureties of the same amount, as pronounced by Justice Rudra Prakash Mishra.

Issues considered

  • Whether bail can be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in the absence of direct incriminating evidence
  • Whether non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, bars the grant of bail
