Patna High Court

Ranjeet Chaudhary @ Ranjit Kumar ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Bail was denied because the trial had already commenced and witnesses were being examined.

Summary

The petitioner, Ranjeet Chaudhary, applied for regular bail in a criminal case under Sections 302 and 34 of the Indian Penal Code. This was his second bail application after a prior petition was rejected on 18 January 2025. The trial in the matter has already commenced, with three witnesses examined in the ongoing proceedings before the 15th Additional District Judge, Vaishali. The petitioner argued that bail should be granted despite the trial's progress. The Court, after hearing counsel, held that the commencement of trial and ongoing witness examination warranted denial of bail. Consequently, the petition for bail was rejected.

2 25-02-2026 1. Heard learned counsel for the petitioner and

                   learned A.P.P. for the State.

                                2. The petitioner seeks bail in a case registered for the

offences punishable under Sections 302/34 of the Indian Penal

                   Code.

                                3. Learned counsel for the petitioner submits that this

is the second attempt of the petitioner to seek regular bail as the

petitioner had earlier moved before this Court seeking regular

bail by filing Cr. Misc. No. 72926 of 2024 and the same came to

be rejected by an order dated 18.01.2025. It is fairly submitted

that the trial has commenced and the witnesses are being

examined and till date three witnesses have been examined.

                                4. After hearing the learned counsel for the parties,

the Court is not inclined to release the petitioner on bail since

the trial has commenced and the witnesses are being examined

in connection with S.Tr. No. 537 of 2024 along with 59 of 2025

arising out of Mahua P.S. Case No. 692 of 2023 pending in the

Court of learned 15th Additional District Judge, Vaishali at

                                  5. Hence, the prayer for bail is again rejected.

                                                                          (Satyavrat Verma, J)
