Decided

Holding

The petition was dismissed as infructuous because the original criminal proceeding had already been disposed of.

Summary

The petitioners, a group of relatives, filed a petition under Section 482 of the Criminal Procedure Code seeking to quash the charge sheet framed by the Sessions Judge in S.T. No. 261 of 2018 on the ground that no material was placed on record. The High Court noted that the underlying criminal proceeding had already been disposed of on 8 September 2025, as per the report of the Sessions Court. The petitioners argued that the case had become infructuous and should be dismissed. The State, through its Additional Public Prosecutor, raised no objection to the petitioners' request. Considering the disposal of the original case, the Court held that the petition was moot. Consequently, the petition was disposed of as infructuous.
