Pujan Yadav @ Shivpujan KumarversusThe State of Bihar

Holding

The application for anticipatory bail is allowed, with provisional bail granted subject to conditions.

Summary

The petitioner, Pujan Yadav, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, where 200 litres of spirit were allegedly recovered from a bush not belonging to him. He argued that the recovery was not from his conscious possession and that the police had mechanically implicated him without proper investigation, despite his three prior excise cases. The State opposed the bail application. The High Court, after hearing counsel, directed the petitioner to furnish a bail bond of Rs.15,000 with two sureties and granted provisional anticipatory bail subject to Section 482(2) of the Code of Criminal Procedure. The order conditioned the trial court to verify the petitioner’s criminal antecedents; if more than three prior cases are found, the bail would not be confirmed. Additionally, the petitioner was ordered to deposit Rs.5,000 with the High Court Legal Services Committee within two weeks. The application was allowed, subject to the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the CrPC in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.

          application.

                       5. Considering the submissions made by the learned

the criminal antecedent of the petitioner and in the event, if it is

found that petitioner has antecedents of more than three cases,

then it would be presumed that petitioner for the purposes of
