Provisional anticipatory bail is granted subject to bail bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Sukhari Sahni, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2018, involving the alleged recovery of 149.76 litres of liquor from a motorcycle. He argued that he was not arrested on the spot, did not own the vehicle, and was implicated based on secret information without proper investigation, despite having three prior excise cases. The State opposed the bail. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.15,000 with two sureties and conditioning confirmation on verification of the petitioner’s criminal antecedent. If more than three prior cases are found, the bail will not be confirmed; if only three, it will be confirmed. The petitioner also undertook to deposit Rs.5,000 with the Patna High Court Lawyers’ Association.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C. in a case under the Bihar Prohibition and Excise Act, 2018.
  • Whether the petitioner’s prior criminal antecedent warrants denial of anticipatory bail.
