Patna High Court

Ugan Kunwar @ Ugan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail.

Summary

Ugan Kunwar was arrested in connection with a land‑dispute case (Laukaha PS Case No. 207 of 2024) alleging assault, robbery and other offences under the B.N.S., 2023. He applied for bail, claiming he was merely a member of the mob and had no specific overt act attributed to him. The prosecution alleged that the accused stopped the informant’s bike, assaulted him, and stole money, a mobile phone and the bike. The petitioner’s counsel argued that co‑accused had already been granted bail and that the petitioner had no criminal antecedents and had been in custody since 14‑11‑2025. The court, noting the lack of a specific allegation against the petitioner and the bail already granted to co‑accused, decided to enlarge the petitioner on bail. Accordingly, bail was granted on a bond of Rs. 10,000 with two sureties of the same amount.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences alleged
  • Whether the petitioner’s alleged role as a mere member of the mob suffices to justify bail
