Patna High Court

Md. ChandversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, Md. Chand, was arrested in connection with a robbery in which goods worth Rs. 5 lakh were allegedly stolen from a shop. He was charged under sections 303(2), 334(1), 317(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023, and has been in custody since 16 May 2025 with a charge‑sheet already filed. The petitioner sought regular bail, contending that co‑accused in the same case had already been released on bail on three separate orders. The State opposed the bail application. Considering the seriousness of the allegations, the fact that co‑accused were granted bail, the petitioner’s prolonged detention of eight months, and the filing of the charge‑sheet, the Court ordered that bail be granted on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the nature of the offences under the Bhartiya Nyaya Sanhita, 2023.
  • Whether the prior grant of bail to co‑accused and the petitioner’s prolonged pre‑trial detention justify bail.
