Patna High Court

Mithlesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner.

Summary

Mithlesh Kumar, married to Riya Kumari, faced a complaint (Case No. 1669/2017) alleging offences under IPC sections 323, 307, 498A and Section 3 of the Dowry Prohibition Act, claiming dowry demands and cruelty. The petitioner sought anticipatory bail, asserting innocence and that he has been trying to settle the matter since 2017, while the complainant failed to appear despite notices. The court noted the marital discord, that the offences are triable by a magistrate, and that there was no likelihood of the petitioner absconding. Considering these factors, the court granted anticipatory bail on the condition of a bail bond of Rs. 10,000 with two sureties and subject to Section 482(2) of the B.N.S.S. 2023. The order directs release upon arrest or surrender within four weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of non‑appearance of the complainant and alleged offences.
  • Whether the nature of the offences (triable by a magistrate) and lack of flight risk justify bail.
  • Whether conditions under Section 482(2) of the B.N.S.S. 2023 can be imposed on anticipatory bail.
