Holding
The court held that bail cannot be granted as there is no new ground and the trial is at an advanced stage.
Summary
The petitioner, Utkarsh Raj, applied for regular bail in a case involving offences under Sections 376(D), 120(B)/34 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act. This was his third bail application after earlier rejections by the same court. The court observed that the charge‑sheet had been filed, charges framed, and all prosecution witnesses except the investigating officer had been examined, with the trial expected to conclude within three months. The petitioner contended that he had no prior criminal record and had been in judicial custody since September 2023. The State opposed bail, and the court found no new ground for relief, noting the trial was at an advanced stage, and therefore rejected the bail petition, directing the lower court to expedite the trial within a month.
Issues considered
- Whether bail should be granted to the accused for offences under IPC 376(D), 120(B), 34 and POCSO Act 4/6 given the stage of the trial
- Whether any new ground exists to merit granting bail after previous rejections
- Whether the advanced stage of the trial justifies denial of bail
