Ranjan Kumar Das @ Ranjan KumarversusThe State of Bihar

Holding

Bail was granted to petitioner No. 1 with conditions, and denied to petitioner No. 2.

Summary

Petitioners Ranjan Kumar Das and Khiro Das were charged under several IPC sections for assaulting an informant with an axe and another person with a knife, causing injuries. They applied for pre‑arrest bail, claiming a clean antecedent. The State opposed bail, arguing that the injury caused by petitioner No. 2 was grievous. The Court noted that the allegation against petitioner No. 1 was a general, omnibus assault and, considering his clean antecedent, granted him bail on a bond of Rs 10,000 with two sureties, subject to conditions under section 482(2) of the BNSS, 2023. Conversely, the Court rejected the bail application of petitioner No. 2, finding the nature of the accusation serious enough to deny pre‑arrest bail. The order was pronounced by Justice Prabhat Kumar Singh of the Patna High Court.

Issues considered

  • Whether pre‑arrest bail should be granted to petitioner No. 1 under the circumstances of a general assault allegation and clean antecedent.
  • Whether pre‑arrest bail should be granted to petitioner No. 2 given the alleged grievous injury caused.
