The High Court granted provisional anticipatory bail subject to bail bond, surety, deposit, and verification of antecedents, exercising its inherent powers under Section 482(2) of the CrPC.

Summary

The petitioner, Rajesh Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018, relating to alleged recovery of liquor from an agricultural field. He argued that no liquor was found in his possession and that the alleged site did not belong to him, contending that the investigation was based on secret information. The State opposed the bail. The High Court, considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and a requirement to deposit Rs.5,000 with the Advocates’ Association. The order was made subject to verification of the petitioner’s criminal antecedents, with a provision that the bail would be confirmed only if he has at most two prior cases, otherwise it would be withdrawn. The court exercised its inherent powers under Section 482(2) of the CrPC to issue the provisional bail.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 given the petitioner’s antecedent cases
  • Whether the High Court can impose conditions and a verification mechanism under its inherent powers while granting anticipatory bail
