Holding

The application under Section 482 is dismissed as infructuous.

Summary

Shatrughan Kumar Mehta filed a criminal miscellaneous application under Section 482 of the Criminal Procedure Code seeking to quash Complaint Case No.743 of 2018, which alleged offences under Sections 379, 498A, 323, 504 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act. The trial court had already discharged the petitioner on 6 April 2024 and the parties had reached a compromise. The petitioner argued that the case had become infructuous and should be disposed of. The State of Bihar raised no objection to the prayer. The Patna High Court, after considering the submissions and the trial court report, held that the application was indeed infructuous and disposed of it.

Issues considered

  • Whether the criminal complaint can be quashed under Section 482 of the Cr.P.C. after the petitioner has been discharged and the matter compromised
