Provisional anticipatory bail is granted subject to bail bond, sureties and verification of the petitioner’s antecedents.

Summary

Santosh Ram, a resident of East Champaran, applied for anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act for alleged recovery of 35 litres of liquor from a field not owned by him. He argued that he has a clean antecedent, no possession of the liquor, and that the complaint originated from a chowkidar who failed to inform police earlier, casting doubt on the prosecution’s case. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and a condition that the trial court verify the petitioner’s antecedents. If any antecedent is found, the bail would not be confirmed; if none, the bail would be confirmed. The petitioner also undertook to deposit Rs.1,500 with the Advocates’ Association within two weeks.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
  • Whether the petitioner’s clean antecedent and lack of possession justify granting bail.
  • Whether the circumstances of the liquor recovery from a field not belonging to the petitioner affect the bail decision.
