Patna High Court

Monir Miya @ Manir MiyaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court grants bail to the petitioner.

Summary

Monir Miya was arrested in connection with a 2016 case involving alleged assault, arson and the death of a woman, charged under IPC Sections 341, 323, 326, 307, 504, 34 and later 302. The petitioner claimed innocence, stating that no incriminating material was found on his person and that the charge‑sheet was vague and omnibus. He had been in custody since 2 October 2024 and had no prior criminal record, while a co‑accused had already been granted bail. The State opposed bail, citing the seriousness of the offences. Considering the length of custody, lack of specific evidence against the petitioner and his clean record, the Court granted bail on a bond of Rs 15,000 with two sureties of the same amount.
