Patna High Court

Prasanjeet Singh @ Prasanjeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to conditions under Section 482(2) of the BNSS.

Summary

The petitioner, Prasanjeet Singh, was named in an FIR for offences under Sections 341, 323, 324, 307, 447, 379, 504 and 34 of the Indian Penal Code arising from a dispute over a passage that led to a violent altercation. He contended that he has a clean antecedent, was falsely implicated, and that the injuries sustained were simple in nature. The State opposed his prayer for anticipatory bail. The Court, after considering the petitioner's clean record and the nature of the injuries, granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the BNSS. The order directs the petitioner to surrender within six weeks if arrested and to comply with the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the serious IPC offences alleged.
  • Whether the petitioner is likely to flee, tamper with evidence, or influence witnesses.
  • Whether the nature of the injuries and the petitioner's clean antecedent justify bail.

                             2. The petitioner apprehends his arrest in a case
