Holding
The Court held that the criminal miscellaneous application is infructuous and therefore disposed of.
Summary
The petitioner, Ranjeet Singh Rana, filed a criminal miscellaneous application under Section 482 of the Criminal Procedure Code seeking quashment of FIR No. 107 of 2017, which alleged offences under Sections 147, 149, 353, 420, 504, 506 and 120B of the Indian Penal Code. The FIR had already been disposed of, and the petitioner had been acquitted by the Principal District & Sessions Judge, Buxar on 29 March 2023. The petitioner argued that, having been acquitted, the FIR was now infructuous and should be dismissed. The State, through its Additional Public Prosecutor, raised no objection to the petitioner's prayer. The Court, after considering the submissions and the report confirming the acquittal, held that the application was infructuous and ordered its disposal. Consequently, the FIR was not quashed but the pending application was dismissed as moot.
