Holding
The Court held that bail should be granted to the petitioner, subject to monetary bond and conditions of appearance.
Summary
The petitioner, Rahul Kumar, was arrested as the driver of a Mahindra Bolero from which 252 litres of liquor was seized, and was charged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act. He claimed innocence, stating he was not the owner of the vehicle, had no knowledge of the contraband, and that no incriminating material was found in his possession. The petitioner also argued that Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, had not been complied with. The State opposed bail. Considering the lack of personal possession of the liquor, the petitioner’s clean record, and the period already spent in custody, the Court granted bail subject to a cash bond and sureties, and imposed conditions of regular appearance. The bail order was issued on 2‑Feb‑2026.
Issues considered
- Whether bail should be granted to the accused under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.
- Whether the non‑compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, bars the grant of bail.
- Whether the driver of a vehicle can be held liable for the possession of illicit liquor without proof of knowledge or control.
