Patna High Court

Anrudh Singh @ Anirudh Singh @ Arun SinghversusThe State Of Bihar

Decided

DISPOSED

Holding

The Court disposed of the application as infructuous, declining to quash the earlier order.

Summary

The petitioner, Anrudh Singh, filed a criminal miscellaneous application under Section 482 of the Criminal Procedure Code seeking to quash an order dated 23 May 2018 passed by the Additional Chief Judicial Magistrate‑VI, Saran, which had taken cognizance of offences under Sections 413, 414, 467, 468, 471 and 34 of the Indian Penal Code. The petitioner argued that the proceedings had become infructuous and therefore the application should be dismissed. The State of Bihar raised no objection to the petitioner's request. The High Court examined whether the application could be entertained given the alleged infructuity of the case. Considering the submissions and the lack of opposition, the Court held that the matter was indeed infructuous and disposed of the application without granting any relief. Consequently, the order sought to be quashed remains unaffected, but the application itself was closed.

Issues considered

  • Whether the criminal miscellaneous application under Section 482 CrPC for quashing the earlier order is maintainable when the proceedings are alleged to be infructuous
