Holding

The court held that provisional anticipatory bail may be granted subject to verification of the petitioner’s antecedent and compliance with conditions under Section 482(2) of the BNSS.

Summary

The petitioner, Vicky Kumar, sought anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Excise Act for allegedly recovering 15.375 litres of liquor from a motorcycle. He argued that he had no prior criminal record, the seized liquor was not in his possession, and the case was based solely on a confessional statement of another accused, which he claimed lacked evidentiary value. The State opposed the bail. The High Court, considering these submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs. 500 with two sureties and deposit Rs. 1,500 with the Advocates’ Association, pending verification of his antecedent by the trial court. The order stipulated that if any prior case is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The court also directed compliance with conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the confessional statement of another accused provides sufficient basis for arrest.
  • Whether the petitioner’s clean antecedent warrants provisional bail pending verification.

Subjects

  • anticipatory bail
  • Section 30(a) Bihar Excise Act
  • Section 482(2) BNSS
  • clean antecedent
  • confessional statement

                             2. The petitioner apprehends his arrest in a case

                             3. Learned counsel for the petitioner submits that the

                             4. Learned counsel for the petitioner submits that the

recovered from his conscious possession and is not the owner of

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                   6. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the

shall verify the criminal antecedent of the petitioner and in the
