Decided

BAIL GRANTED

Holding

The Court grants bail to the petitioner.

Summary

The petitioner, Sonu Kumar, sought bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 14 litres of country-made liquor recovered from a public place. The prosecution alleged the offence, while the petitioner claimed innocence, stating no incriminating material was found in his possession and that the recovery was from an open area accessible to the public. The petitioner had been in custody since 21‑12‑2025 and possessed a prior criminal antecedent, and the State argued against bail. The Court noted the lack of direct evidence, the public nature of the recovery, and the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and decided to grant bail. The bail was set at a bond of Rs. 15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act considering the facts of the case.
  • Whether the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the grant of bail.
