BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to a bail bond and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

Nripnandan Singh was named in an FIR for allegedly assaulting an informant with sticks and bricks, facing charges under several sections of the Bharatiya Nyaya Sanhita. Fearing arrest, he filed an anticipatory bail application, asserting his innocence, a simple nature of injury, and a clean antecedent. The State opposed the bail. The Patna High Court examined the seriousness of the allegations, the modest extent of the injury, and the petitioner’s clean record. Considering these factors, the Court granted anticipatory bail, directing the petitioner to surrender within eight weeks and furnish a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order also stipulated compliance with the Additional Chief Judicial Magistrate, Manjhaul.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the charges under the Bharatiya Nyaya Sanhita
  • Whether the nature of the alleged assault and the petitioner’s antecedents justify bail
