Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner.

Summary

Petitioner Raju Sharma sought anticipatory bail after being implicated in FIR No. 166 of 2025 for alleged assault with intent to kill, under multiple sections of the BNS, 2023. He claimed innocence, alleging the dispute was civil in nature, that the FIR was lodged after a seven‑day delay, and that he has a clean antecedent. The State opposed the bail. The Court examined the FIR, injury report and the petitioner's submissions, noting that the injuries were simple and the allegations against the petitioner were not substantiated to a degree warranting arrest. Considering the circumstances, the Court was inclined to grant anticipatory bail. Accordingly, the petitioner was ordered to be released on anticipatory bail upon furnishing bail bonds and sureties, subject to conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the BNSS in view of the allegations under Sections 126(2), 115(2), 118(1), 109, 74, 351(2), 352 and 3(5) of the BNS, 2023.
