The petitioner is to be released on bail subject to the conditions stipulated under Section 480(3) of the B.N.S.S.
Summary
The petitioner, a journalist named Ramprit Yadav, was arrested after a police‑civilian clash over alleged illicit liquor sales, where a mob allegedly attacked police personnel. The prosecution charged him under numerous sections of the B.N.S., 2023 and Section 27 of the Arms Act, alleging he led the mob, though no specific overt act was attributed to him. The petitioner contended he was merely recording the incident and had been falsely implicated, emphasizing his clean antecedent and that a chargesheet had already been filed. The State opposed bail, while the court noted the non‑specific nature of the allegations, the petitioner’s custody duration, and the existence of a chargesheet. Consequently, the court granted bail on a Rs 10,000 bond with two sureties and imposed conditions under Section 480(3) of the B.N.S.S.
Issues considered
- Whether the petitioner is entitled to bail despite serious charges under the B.N.S., 2023 and the Arms Act
- Whether the prosecution’s non‑specific allegations and lack of a specific overt act justify granting bail
- Whether the petitioner’s period of custody and the filing of a chargesheet affect the bail decision
