Patna High Court

Ramjee YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs 10,000, two sureties and conditions under Section 480(3) of the B.N.S.S.

Summary

Ramjee Yadav was arrested for allegedly blocking a road during a protest over a death and for leading a mob that attacked a police party with lathis, sticks, bricks and stones. The prosecution alleged offences under numerous sections of the Bihar Negotiable Statutes (B.N.S., 2023), but no injuries were reported and there was no complaint from the public. The petitioner argued that he was falsely implicated, highlighted that a co‑accused (Shiv Yadav) had already been granted bail in a similar case, and noted his long custody since 4 December 2025 and the filing of a chargesheet. The State opposed bail, but the court, considering the non‑specific nature of the allegations, the precedent of bail to the co‑accused, and the petitioner’s custody period, ordered his release on bail with a bond of Rs 10,000 and two sureties, subject to conditions under Section 480(3) of the B.N.S.S. and other standard bail conditions. The bail was granted, and the petitioner was directed to appear as required by the trial court.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences alleged under the B.N.S., 2023.
  • Whether the precedent of bail granted to a similarly placed co‑accused warrants bail in the present case.
