The Court disposed of the application, granting the petitioners liberty to raise all points before the trial court as prayed for.

Summary

The petitioners, Adyanand Singh, Sarvanand Singh and Lal Bihari, filed a criminal miscellaneous application under Section 482 of the Criminal Procedure Code seeking to quash an order dated 06-10-2017 passed by the ADJ‑I‑cum‑Special Judge of the SC/ST Act, Aurangabad, which had taken cognizance of offences under IPC sections 341, 323, 504, 349 and Section 3(i)(r)(3) of the SC/ST Act. The petitioners argued that the matter should be allowed to be taken up before the trial court at the appropriate stage. The State of Bihar raised no objection to the prayer. The High Court, after hearing counsel, disposed of the application, granting the petitioners liberty to raise all points before the trial court as prayed for.

Issues considered

  • Whether a criminal miscellaneous application under Section 482 Cr.P.C. can be entertained to quash the order of the Special Judge taking cognizance of offences.
