The Court modified the order to reflect the correct address and extended the time for furnishing bail bonds by six weeks.

Summary

The petitioner, Lalji Sahani, filed an application seeking modification of the order dated 24‑09‑2025 to correct a clerical error in his address and to obtain an extension of time to furnish bail bonds. The order mistakenly recorded his address as Village‑Dipahu, Dhangad Toli, P.S.‑Kotwa, whereas the correct address is Village‑Jhitkahiya, P.S.‑Lakhaura, District‑East Champaran, Motihari. The State had no objection to correcting the address. The Court, after considering the facts, read the correct address into the earlier order and extended the period for surrendering the bail bond by six weeks on the same terms. Consequently, the modification application was allowed and the earlier order was accordingly amended.

                                       ORAL ORDER

2 06-02-2026 Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The present application has been filed seeking

modification of the order dated 24.09.2025 passed in Criminal

Miscellaneous No. 65599 of 2025, confined to correction of the

address of the petitioner as mentioned in the said order as well

as extension of time for furnishing bail bonds of the petitioner

                                3. Learned counsel for the petitioner submits that due

to an inadvertent error, the address of the petitioner has been

wrongly mentioned in the order dated 24.09.2025 as Village–

Dipahu, Dhangad Toli, P.S.–Kotwa, District–East Champaran,

whereas the correct and actual address of the petitioner, as

          reflected in the F.I.R., is Village–Jhitkahiya, P.S.–Lakhaura,

District–East Champaran, Motihari but due to mistake in order

of Special Judge the address of petitioner is given as Village-

Dipahu, Dhangad tolili, P.S. Kotwa, District-East Champaran

and on account of the said discrepancy, the bail bond of the

petitioner could not be accepted by the concerned trial court. It

is submitted that the correct address of the petitioner is Village-

Jhitkahiya, P.S. Lakhaura, District- East Champaran, Motihari.

Hence, he prays that addressof the petitioner be modified as

Village- Jhitkahiya, P.S. Lakhaura, District- East Champaran,

          Motihari.

                       4. Learned A.P.P. for the State has no objection to the

prayer made for correction of the address.

                       5. Considering the facts and circumstances of the case

and the submissions advanced on behalf of the parties, in the

order dated 24.09.2025, in place of address of petitioner

          -Village–Dipahu, Dhangad Toli, P.S.–Kotwa, District–East

Champaran, it be read as Village- Jhitkahiya, P.S. Lakhaura,

District- East Champaran, Motihari and time for surrender of the
